These Terms of Service govern your access to and use of the Initial Anklet website and your purchase of products from Initial Anklet.

By visiting the website, placing an order, or using our services, you agree to these Terms of Service.

1. Eligibility

You must be at least the age of majority in your province, state, or country to make a purchase, or have permission from a parent or legal guardian.

You may not use the store for an unlawful, fraudulent, or unauthorized purpose.

2. Store information

We try to ensure that product descriptions, images, prices, availability, measurements, and other information are accurate.

However:

  • Colours may appear differently depending on lighting, photography, and screen settings.
  • Measurements are approximate.
  • Product packaging or minor design details may change.
  • Availability may change without notice.

We may correct errors, update information, or cancel an affected order where information was materially incorrect. Nothing in this section limits rights that cannot lawfully be excluded.

Canadian law prohibits materially false or misleading product representations, so product claims should accurately reflect the item being sold.

3. Product care and expected wear

Jewelry naturally experiences wear over time.

“Tarnish-resistant,” “water-resistant,” and similar descriptions do not mean that an item is indestructible or guaranteed never to change appearance. Exposure to chlorine, saltwater, perfume, lotions, cleaning products, friction, and prolonged moisture may affect the finish.

Customers should follow the care instructions provided on the product page or packaging.

4. Orders

Submitting an order is an offer to purchase. An order is not finally accepted until payment has been authorized and we send an order confirmation or begin fulfillment.

We may refuse, limit, or cancel an order where:

  • Payment cannot be verified
  • Product or pricing information was incorrect
  • Fraud or unauthorized activity is suspected
  • The item is unavailable
  • The order violates these Terms

If we cancel an order after payment has been captured, we will refund the affected amount to the original payment method.

5. Initial and colour selection

Customers are responsible for reviewing their selected:

  • Initial
  • Colour or finish
  • Quantity
  • Shipping address
  • Contact information

before submitting an order.

Contact us immediately if a selection is incorrect. We cannot guarantee changes once processing or fulfillment has begun.

6. Prices and payments

Prices may be displayed in the customer’s selected or local currency. Final charges may vary due to currency conversion performed by the payment provider or card issuer.

Applicable taxes, shipping charges, and other fees will be displayed at checkout where possible.

International customers are responsible for customs duties, import taxes, brokerage fees, and similar charges unless the checkout expressly states that they are included.

We may change prices at any time, but a price change will not affect an order already accepted, except where an obvious error occurred.

Any advertised comparison or sale price must reflect a genuine selling-price basis and will not be used to create a misleading discount.

7. Shipping and delivery

Estimated processing and delivery times are estimates, not guaranteed arrival dates, unless expressly stated otherwise.

Delays may occur because of:

  • Carrier disruptions
  • Customs processing
  • Weather
  • Holidays
  • Incorrect address information
  • Supplier or inventory issues
  • Events outside our reasonable control

Customers must provide a complete and accurate shipping address. Additional charges resulting from an incorrect or incomplete address may be the customer’s responsibility.

Nothing in these Terms limits any statutory right to cancel or obtain a refund when an order is not delivered within a legally required period. Ontario’s Consumer Protection Act provides specific rights where goods are not delivered within 30 days after a promised delivery date.

8. Returns and refunds

Returns, replacements, and refunds are governed by our Return and Refund Policy, which forms part of these Terms.

9. Customer accounts

If accounts are available, you are responsible for:

  • Maintaining the confidentiality of your password
  • Providing accurate account information
  • Restricting unauthorized access to your device
  • Notifying us of suspected unauthorized use

We may suspend or terminate accounts used for fraudulent, abusive, or unlawful conduct.

10. Reviews and customer content

If you submit a review, photograph, video, comment, or other content, you confirm that:

  • You own it or have permission to submit it
  • It does not infringe another person’s rights
  • It is not fraudulent, defamatory, unlawful, or misleading

You grant Initial Anklet a non-exclusive, worldwide, royalty-free licence to display, reproduce, adapt, and use submitted content for operating and promoting the store, unless otherwise agreed in writing.

We will not knowingly create or publish fake customer reviews or materially misrepresent a person’s experience.

11. Intellectual property

The website and its content—including the Initial Anklet name, logos, graphics, designs, text, photographs, videos, and layout—are owned by or licensed to Initial Anklet and are protected by applicable intellectual-property laws.

You may use the website only for personal, non-commercial shopping purposes.

You may not reproduce, distribute, scrape, sell, modify, publish, or exploit website content without written permission.

12. Prohibited conduct

You may not:

  • Use the store for unlawful or fraudulent activity
  • Submit false information
  • Interfere with website security
  • Introduce malware or harmful code
  • Attempt unauthorized access to accounts or systems
  • Scrape or harvest customer data
  • Copy or commercially exploit store content
  • Use automated systems in a way that disrupts the store
  • Violate another person’s privacy or intellectual-property rights

13. Third-party services and links

We may use or link to third-party services, including Shopify, payment providers, shipping carriers, social-media platforms, and fulfillment partners.

We are not responsible for third-party websites or services that we do not control. Their use may be governed by separate terms and privacy policies.

14. Disclaimer

To the fullest extent permitted by law, the website and services are provided on an “as available” basis.

We do not guarantee that the website will always be uninterrupted, error-free, or free of harmful components.

Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot legally be excluded.

15. Limitation of liability

To the fullest extent permitted by applicable law, Initial Anklet will not be liable for indirect, incidental, special, punitive, or consequential damages resulting from the use of the store or products.

Where liability cannot be excluded, our liability will be limited only to the extent permitted by law.

This section does not limit liability for fraud, intentional misconduct, gross negligence, personal injury caused by negligence, or any right that cannot legally be waived.

16. Indemnification

You agree to indemnify and hold Initial Anklet and its service providers harmless from claims, losses, or reasonable expenses arising from your unlawful use of the store, breach of these Terms, or violation of another person’s rights.

This obligation applies only to the extent permitted by law.

17. Severability

If any provision is found invalid or unenforceable, that provision will be limited or removed only to the minimum extent necessary. The remaining provisions will continue in effect.

18. No waiver

A failure to enforce any provision does not waive our right to enforce it later.

19. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without excluding mandatory consumer protections that apply in a customer’s home jurisdiction.

20. Changes to these Terms

We may update these Terms from time to time by posting the revised version with a new “Last updated” date.

Changes do not retroactively alter an order already accepted unless required by law or agreed with the customer.
